Agreement to Terms
By accessing or using the Pathie mobile application ("App," "Service," "Pathie"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the App.
1. Service Description
1.1 What Pathie Does
Pathie is a mobile application designed to help parents and guardians:
- Discover activities aligned with their children's goals and dreams
- Find local activity providers and classes
- Plan and schedule activities
- Track activity completion and progress
- Manage multiple children's activity plans
1.2 What Pathie Is NOT
Important: Pathie is:
- Not a booking service - We help you find providers, but you book directly with them
- Not a daycare or childcare service - We are a planning tool only
- Not a background check service - We do not vet or verify activity providers
- Not responsible for provider quality - Provider information comes from Google Places API
2. Eligibility
- You must be at least 18 years old to create an account
- You must be a parent or legal guardian of the children you add to the app
- Children under 13 may not create their own accounts
- You are responsible for all activities that occur under your account
3. User Responsibilities
3.1 Prohibited Conduct
You agree NOT to:
- Use the App for any illegal purpose
- Violate any local, state, national, or international law
- Harass, abuse, or harm others
- Impersonate any person or entity
- Upload viruses, malware, or malicious code
- Attempt to gain unauthorized access to the App or our systems
- Scrape, crawl, or spider the App
- Use automated systems (bots) to access the App
- Interfere with or disrupt the App's functionality
4. Third-Party Services and Providers

YOU ACKNOWLEDGE THAT:
- We do not employ, supervise, or control activity providers
- Providers are independent third parties
- You are solely responsible for:
- Researching and vetting providers
- Verifying credentials and background checks
- Ensuring provider safety and quality
- Making all booking and payment arrangements
- Supervising your child during activities
Safety Recommendations:
- Always verify provider credentials and licenses
- Conduct background checks when appropriate
- Visit facilities in person before enrolling
- Review provider policies and safety measures
- Trust your instincts about provider suitability
- Report any concerns to appropriate authorities
5. Disclaimers and Limitations of Liability
5.1 "AS IS" Service
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
- Warranties of merchantability
- Fitness for a particular purpose
- Non-infringement
- Accuracy or reliability of information
- Uninterrupted or error-free operation
5.2 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PATHIE SHALL NOT BE LIABLE FOR:
- Any indirect, incidental, special, or consequential damages
- Loss of profits, data, or use
- Personal injury or property damage
- Damages arising from provider interactions
- Damages from unauthorized access to your account
- Any damages exceeding $100 or the amount you paid us (if any)
6. Indemnification
You agree to indemnify, defend, and hold harmless Pathie, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from:
- Your use of the App
- Your violation of these Terms
- Your interaction with activity providers
- Any harm to your child
7. Privacy and Data Protection
Your use of the App is also governed by our Privacy Policy, which is incorporated by reference into these Terms.
8. Account Termination
You may delete your account at any time through Settings > Manage Account > Delete Account. We may suspend or terminate your account if you violate these Terms or engage in prohibited conduct.
9. Dispute Resolution
ARBITRATION AGREEMENT - PLEASE READ CAREFULLY
You and Pathie agree that disputes will be resolved through binding arbitration, NOT in court (except for small claims court or injunctive relief).
Arbitration terms:
- Individual basis only (no class actions)
- Conducted under the American Arbitration Association (AAA) rules
- Located in your state of residence
- You may opt out within 30 days by emailing optout@pathieapp.com
Class Action Waiver: You agree to bring claims only in your individual capacity, not as part of a class action or representative proceeding.
10. Fees and Payments
Pathie is currently free to use. We do not charge fees for account creation, activity discovery, provider search, or scheduling features.
We reserve the right to introduce paid features or subscription plans in the future with at least 30 days notice.
11. Changes to Terms
We may modify these Terms at any time. We will notify you of material changes via in-app notification. Your continued use of the App after changes are posted constitutes acceptance of the modified Terms.
12. Governing Law
These Terms are governed by applicable laws, without regard to conflict of law principles.
